ARE YOU A FOREIGNER AND WANT TO BUY A PROPERTY IN EL SALVADOR?..VERY WELL.. BUT...BE CAREFUL!

Okay, I'm not going to talk about El Salvador being a violent country with a slow economic growth .. maybe you already know that. But you have many advantages, when you buy a property in the country if you are a foreigner, low prices, reasonable tariffs, and legislation that ensures your property. But you have to choose the correct one !. You can not buy any property. In El Salvador there are 2 types of property: 1) The normal property that indicates Art.568 of the Salvadoran Civil Code that allows the use, and enjoyment of property, you find this property in cities under the form of houses, and apartments , you also find it in the countryside and the beach in the form of farms or ranches. If you are a foreigner you will not have any problem buying this type of property; and 2) The agricultural property that is in Art.105 of the Constitution of the Republic of El Salvador, which is developed by means of the Law of the Special Property Regime for the Agricultural, Communal Cooperatives and beneficiaries of the agrarian reform ( Yes, it's a very long name for a law!). This type of property is only intended for the production and agricultural exploitation of the land, you only can work it to make it produce. With this property you can not do a real estate development, condominiums or build houses for sale to people who do not work the land or they are not agriculturist or farmer. In addition to be the owner of this type of property you must be a: 1) Farmer. 2) Settler registered in the register of the Ministry of agriculture of El Salvador, 3) Cooperative partner and 4) Beneficiary of land reform. If you do not have any of those 4 qualities, you can not acquire this type of property. In summary, yes, you can acquire properties in El Salvador as a foreigner, but make sure that they are not agricultural properties. How do you know if there is agricultural properties, if looks the same for you?. You should ask about the property antecedent in the Registry of the Root Property and Mortgages of El Salvador (www.cnr.gob.sv). Remember El Salvador is your home and I am your friend. :)

SE INVITA A LOS ABOGADOS Y NOTARIOS DE EL SALVADOR A LA PRESENTACIÓN DEL LIBRO "LA FUNCIÓN SOCIAL DEL ESTADO DE DERECHO".

Si usted nos lo permite, queremos dispensar unos minutos de su valioso tiempo, para hacer de su conocimiento que el día miércoles 28 de junio de este año, se llevará a cabo en el campus II de la Facultad de Derecho de la Universidad Dr. José Matías Delgado, la presentación del libro "LA FUNCIÓN SOCIAL DEL ESTADO DE DERECHO" por la Dra. Verónica Jaime, quien es la autora de tal obra.

Se Anexa la invitación abierta que hace la Universidad para su asistencia donde se brindará un conversatorio sobre el tema del libro, y un refrigerio.

Llamamos su atención sobre éste evento licenciado(a), no solo por lo interesante del tema, pues el concepto jurídico de "función social" es uno de los más difíciles de estructurar; a decir verdad ni los teóricos, ni juristas de todas la épocas del derecho se han logrado poner de acuerdo sobre lo que realmente significa dicho concepto.

Es más, ni las actuales salas de Corte Suprema de Justicia, ni sus antecesoras desde 1984, han logrado definir jurisprudencialmente el concepto de "función social del Estado", siempre se han escudado en la "variedad de corrientes" del derecho al referirse a dicho concepto.

Pero ahora que se presenta un estudio serio, y más aún, respaldado por un centro académico muy reconocido; ciertamente, es importante que su institución se vea representada en la exposición de esa obra, ya que el concepto de "función social" involucra la existencia misma de las instituciones estatales salvadoreñas.

Sería una completa lastima, que ningún representante suyo o su persona, estuviera presente en el citado evento, y mucho más, si no se lograra adquirir una copia del libro para su biblioteca particular.

Por lo anterior licenciado(a), creemos que es importante se coordine los recursos necesarios, para que eventos como esos, sirvan de insumo a su formación profesional, y en beneficio de sus clientes en general.
